Supreme Court Passes Lazy 8 Casino
After three years of battling the good folks and residents of Spanish Springs with John Ascuaga’s Nugget, it looks like Harvey Whittemore and the Peppermill Resorts are going to be building their new casino after all.
The issue before the court was that city of Sparks was in cahoots with Whittemore in passing the zoning for the casino and voted behind closed doors to approve without an open meeting which would have required a public vote.
The Supreme Court dismissed the case filed by JAN on the basis that “there is no evidence on the record suggesting that the city acted arbitrarily or capriciously by choosing to settle a lawsuit that could have cost the city millions of dollars.”
Next step for Whittemore, final approval by the city council which will require a final city council vote to “certify” the decision so that they can submit to the Regional Planning Commission. This vote will be taken on July 27th.
I think that the casino is going to be a great improvement and asset to the community of Spanish Springs which has been hard hit with the depressing sub market values on all property out there. Wingfield Springs is also going to benefit hugely by the new complex which will include an 18,000 sq. foot casino, a 200 room hotel, restaurants, shopping and a 14 screen movie theatre.
Cost of the lawsuit? $100 million. Go figure where those resources could have been used.
